Terms of Service

1. Who we are

These Terms of Service ("Terms") apply to all orders placed on buymybeatshere.com. The seller is:

("we", "us"). You are our customer. A consumer is a natural person who orders for purposes that are mainly outside their trade, business or profession. Where a rule applies only to consumers, we say so.

Our shop is meant for adults. If you are under 18, you may order only with the consent of your parent or legal guardian.

2. What we sell

We sell digital audio content as downloadable files only. We do not sell physical products.

We sell beats: instrumental music, offered under the license you choose at checkout. The license options and their limits are shown on each beat's page, and the full license agreement can be read before you buy.

To use the files you need an internet connection, a device that can download and store them, software that opens ZIP archives, and audio software that plays MP3 and WAV files.

The audio previews on our website are for listening only. They may not be downloaded, recorded or used in any other way. Where we offer a tagged file as a free download, it may be used for non-profit purposes only; a commercial release requires a license.

3. How an order works

Showing a product on our website is an invitation to order, not a binding offer.

  • Choose a license on the beat's page and add it to your cart.
  • Open the cart, check its contents and enter your e-mail address, your full legal name and, if you have one, your artist name. We need your legal name because it appears in your license agreement.
  • Confirm that you agree to these Terms and give the declaration about immediate delivery (section 7).
  • Click "Order and pay". You are taken to the payment page of our payment provider, Stripe, where you enter your payment and billing details and complete the payment. By completing the payment you place a binding order.

Until you complete the payment you can change or empty your cart, go back, or leave the payment page without ordering.

The contract is concluded when we confirm your order, either by showing your order page with the downloads or by sending the order confirmation e-mail, whichever comes first. The contract language is English.

Exclusive rights to a beat are not sold through the cart. On the beat's page you can make an offer: you enter the amount, your e-mail address, your full legal name and, if you have one, your artist name. An offer is not yet a contract, and we are free to accept it or not. We answer by e-mail: we accept, decline, or name a price of our own. If we accept or name a price, the e-mail contains a link to a payment page; you are free not to use it. On that page you confirm that you agree to these Terms and give the declaration about immediate delivery (section 7), as in the cart. By completing the payment you place a binding order at the price stated there, and the contract is concluded as described above. Until you have paid, the beat stays on sale and the link stops working if the beat is sold exclusively to someone else. Once exclusive rights are paid for, the beat is removed from the website, and your exclusive rights agreement is delivered in the same way as any other license agreement.

We do not offer customer accounts. We store your order, and you receive your order details, your license agreement and a link to these Terms by e-mail. The current Terms can be read and printed from this page at any time.

4. Prices and payment

Prices are shown in US dollars (USD) and are final: they include any taxes that apply. There are no delivery costs.

Where a discount applies, the cart shows the reduced price before you pay.

  • "Buy 1, get 1 free", while it is shown on the website: of every two beats in one order bought with the same license, one is free. Beats with different licenses are not counted together. We choose which of the two is the free one.
  • Discount codes are entered on the last step of the cart, one code per order. A code may be limited to a period, to a number of uses, or to one order per customer.
  • A personal code, such as one you may receive together with our news, works once, only with the e-mail address it was issued for, and until the time stated with it.

A discount cannot be exchanged for money and does not apply to orders already placed.

Payment is processed by Stripe. The amount is charged when you complete the order. Your bank or card issuer may charge a fee for currency conversion, which is outside our control.

5. Delivery

Your files are available immediately after successful payment, on your order page. We also send you an e-mail with a link to that page.

  • The download links work for 7 days after payment. Download your files within that time and keep a backup.
  • If your links have expired, write to support@buymybeatshere.com with your order number and we will send new ones.
  • You can open your orders again from "Previous orders" in the cart, on the device and browser you ordered with.
  • Do not pass your order link on to anyone else: it gives access to your files.

The digital content is supplied as soon as it has been made available to you for download.

6. License

You do not buy the beat itself. You buy a license to use it. We and our co-producers remain the owners of all rights.

The scope of your rights is set out in the license agreement for the license you chose. It is created with your name when you pay, is attached to your order confirmation e-mail and can be downloaded from your order page. If these Terms and your license agreement say different things about the use of a beat, the license agreement applies.

A non-exclusive license means the same beat can be licensed to other customers. If a beat is later sold exclusively, licenses bought before that sale stay valid for their term, subject to the license agreement.

7. Right of withdrawal and immediate delivery

If you are a consumer, the law gives you the right to withdraw from a contract concluded online within 14 days without giving a reason. The withdrawal instructions are at the end of these Terms.

For digital content that is not supplied on a physical medium, this right ends once we have begun to supply the content, if you expressly agreed that we start before the withdrawal period ends, you acknowledged that you thereby lose your right of withdrawal, and we confirmed this to you by e-mail.

We deliver immediately after payment. This is why you give that declaration by ticking the second checkbox in the cart; an order cannot be placed without it. We record the time of your declaration and confirm it in your order confirmation e-mail.

8. Faulty files and complaints

Your statutory rights for digital content that does not conform to the contract apply. If a file is damaged, incomplete or will not open, write to support@buymybeatshere.com with your order number and a short description. We reply to complaints within 14 days and will first of all send you a working file.

9. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, and for injury to life, body or health. Towards customers who are not consumers, our liability for other damage is limited to the price of the order concerned. Nothing in these Terms limits the rights that consumers have under mandatory law.

10. Use of our website

You may not interfere with the operation or security of our website, get around download limits or other technical protections, or copy content from the website automatically in bulk.

11. Personal data

How we handle personal data is described in our Privacy Policy.

12. Disputes

If something goes wrong, please write to us first: most problems can be solved by e-mail. Consumers can also turn to the consumer ombudsman or a consumer organisation in their country. We are not obliged to take part in out-of-court dispute resolution and decide case by case whether to do so.

13. Governing law

These Terms and all contracts concluded under them are governed by the laws of the Republic of Poland. If you are a consumer, this choice of law does not take away the protection of the mandatory provisions of the law of the country where you live.

14. Changes

We may change these Terms for future orders. The version in force when you place your order applies to that order.

Withdrawal instructions

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract was concluded.

To exercise the right of withdrawal, you must inform us (Ilya Ivakh, trading as Paxor, Kujawska 63/2, 05-270 Marki, Poland, e-mail: support@buymybeatshere.com) of your decision to withdraw by a clear statement, for example an e-mail. You can also use the withdrawal form on our website, linked as "Withdraw from contract" at the bottom of every page. To meet the deadline it is enough to send your statement before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we reimburse all payments received from you without undue delay, and in any event no later than 14 days from the day we are informed of your decision. We use the same means of payment that you used for the original transaction unless you expressly agree otherwise. You are not charged any fee for the reimbursement.

Early end of the right of withdrawal. For digital content not supplied on a physical medium, the right of withdrawal ends once we have begun to supply it, provided you expressly agreed to this, acknowledged that you thereby lose your right of withdrawal, and received our confirmation by e-mail (see section 7).
